TERMS AND CONDITIONS

Our terms and conditions are designed with you, our students in mind. Our priority is for you to enjoy your time with us and to understand both your and our responsibilities to one another when you visit us or book onto one of our activities.

Please read our terms and conditions below.

Please note that if you sign up to any of our facilities or activities additional terms and conditions may apply. If you have any questions, ask us and we will be happy to help you.

 

1.TERMS

Please read these Terms and Conditions before booking onto any activity or purchasing any of our services as by doing so, you agree to our terms and conditions of business and accept our liability waiver.

 

1.     We reserve the right to vary or revoke our Terms and Conditions from time to time, which we may consider necessary or suitable for the regulation of our Studio and the conduct of our Students.

2.     Any changes to our Terms and Conditions will be published on our website and will apply to all Students.

 

2. DEFINITIONS

In these Terms and Conditions, the following definitions apply:

 

Activity and Activities means any of the services that We offer including a single class session, a course, membership, teaching programme, retreat, workshop, or other service.

 

Privacy Policy means our Privacy Policy which may be updated from time to time at our discretion and displayed on our Website and/or available to you on request

 

Student or You means you or any person using the Studio facilities as your guest or in your care

 

Studio means the studio premises of Move Yoga, 45 Melbourne Place, EH39 4JS, North Berwick or any other such venue as We may from time to time run our Activities from including all of the physical spaces that are occupied and part of.

 

Terms or Terms and Conditions are as defined here.

Website means www.moveyoga.co.uk or affiliated website.

We and Us means Move Yoga Ltd a private limited registered at Companies House (Company  no: SC677732), registered office address: 13 Mcleod Green North Berwick trading as Move Yoga

 

3. CONSENT FORMS

If You are a new client, You may be required to fill out a consent form and You will be required to sign a liability disclaimer before participating in your Activity. We require the requested information to complete your profile and to ask important medical information about the state of your health.

 

4. TEACHING SCHEDULE

We reserve the right to modify our class / Activity schedules and opening hours in our absolute discretion. Where a class/ Activity is withdrawn, cancelled, or rescheduled, We will make every effort to notify You promptly and to offer an alternative similar Activity. When a suitable alternative Activity is not available to You, a refund will be issued.

Our classes/ Activities are subject to availability, and We will do our best to get You onto your preferred class/ Activity where We can do so but cannot guarantee a place.

Occasionally We will arrange a substitute teacher when the usual teacher is not able to teach a particular class for any reason. Information about who is teaching the class will be updated on our class timetable. We will aim to arrange substitutes with as much advance notice as We reasonably can, but sometimes it may not be possible to update You or our website in advance of teacher substitution.

We recommend arriving at the Studio at least 10 minutes before the start of class/ Activity and We ask that Students check in with reception. We know that this is not always possible but if You do not check in at least 5 minutes before the start of the Activity your place may be offered to another Student on a waitlist. Late comers will not be admitted.

For health and safety reasons We need to know that You have arrived at the Studio and so it is a strict condition that You check in with reception team before the start of any Activity.

We are unable to allow students who arrive after the start time of the class to attend. No refund will be given to latecomers.

Should you arrive late or cancel late your class credit will be lost (non refundable). Unlimited membership are given a grace of 3 no-shows OR late cancels within a 30 day period. After which a £5 fee will be applied for each occurrence after this.  

5. ATTIRE

Students should dress appropriately for the Activity and remove footwear before participating in the Activity unless directed otherwise by the instructor, subject to these Terms, or as medically advised by a Students medical practitioner. We may ask Students to leave the Studio if We think that their appearance is inappropriate.

 

6. FITNESS & HEALTH

6.1 We shall only provide You with instruction that We are qualified to give. Our guidance and any information that We provide is not a substitute for consultation, diagnosis or medical treatment of your medical practitioner or health care provider. We are not qualified to express an opinion that You are fit to safely participate. You must obtain professional or specialist advice from your doctor before participating.

6.2 If you have concerns about your physical condition, You must not do strenuous physical activities without first getting medical advice to confirm that you are fit to do so.

6.3 You should not take part in any physical Activity that You may not be fit for. You are responsible for monitoring your own condition during the Activity.

6.4 You must inform the Studio Manager or our Instructor prior to attending any Activity about anything that is relevant to your physical condition including but not limited to pregnancy. You must continue to keep this information up to date throughout your participation on our Activities.

6.5 You are responsible for monitoring your own physical condition. If You suffer any unusual symptoms, You must immediately stop the Activity and tell a member of staff at the Studio.

6.6 By attending an Activity, You warrant that You are physically fit and have no medical condition which would prevent your full participation in the Activity.

6.7 We may refuse access or the provision of its services to anyone if, in our absolute discretion, We consider that your health or that of any other Student may be endangered by participating in an Activity.

6.8 You must not participate in an Activity if You are under the influence of alcohol or non-prescription drugs.

6.9 We will observe government guidance relating to Covid safety measures. You should not attend the Studio if You have tested positive for Coronavirus or are displaying symptoms of Coronavirus.

 

7. PERSONAL BELONGINGS & LOCKERS

7.1 All personal belongings brought into our Studio are at the owner’s own risk. We do not accept legal responsibility for any loss or damage to such items. We do not accept any liability for loss or damage to such items or any responsibility for items left on its premises.

7.2 If You leave your belongings at the Studio, We have the right to remove your belongings. We will store removed belongings for up to two weeks after which We may remove them and after this time, will in our discretion, give these items to charity.

7.3 Mobile phones and personal electronic devices should be silenced or turned off upon entry into the Studio and during your visit.

7.4 You may take photos of yourself for personal use only at our Studio but not during an Activity or in changing room areas. Taking photos and filming of other Students or an Activity is strictly prohibited.

7.5 We may request to take photos or film Students during an Activity. Where We take photo images or filming of participation in an Activity, We will ask for your permission and consent to do so first.

 

8. CANCELLATION & REFUNDS

Cancellation Policies

 

Weekly classes
More than 12 hour's notice:  
Receive a credit on your account or you can transfer your credit to another class.

Less than 12 hour's notice: 
No refunds, credits or transfers will be given.

Should you arrive late or cancel late (less than 12 hours before a class) your class credit will be lost (non refundable). Unlimited membership are given a grace of 3 no-shows OR late cancels within a 30 day period. After which a £5 fee will be applied for each occurrence after this.  

 

Workshops & other events/ Activities (excluding Weekly Classes)

Workshops are subject to individual teachers terms of cancelation policy and should be read and accepted by You on booking these.

 

9. MEMBERSHIP AUTO PAY

By signing up for the monthly subscription, You agree that the membership allows, subject to availability, to unlimited access to full price weekly studio peak or off peak, this may exclude some workshops and events. Peak times are from 5pm Monday to Friday.

The membership is personal to the person for whom the membership is bought for and us non-transferrable and cannot be used by anyone else.

The membership starts on the date chosen for the membership to start and renews automatically on a monthly rolling basis on the same date every month until cancelled by you in writing.

The first payment is taken on the date of purchase and renewal payments are taken automatically on the renewal date every month using the stored bank card details provided.

If a renewal payment fails due to card expiry, cancelled card or for any other reason, You are still liable to pay the amount owed using an alternative payment method.

You may choose to cancel the membership anytime within membership terms (3 months for Unlimited or Online and 12 months for Annual) providing You give at least 14 days notice before the next renewal/payment due date. Notice must be given in writing by email to hello@moveyoga.co.uk and We will confirm receipt of such notice by email. Verbal notice cannot be given to cancel this membership.

If the above notice is not given, the monthly payment will be taken and You will not be eligible for any refund either partial or in full.

We reserve the right to cancel this membership at any time by giving a minimum of 14 days notice and such cancellation will then take place on the next payment/renewal date following the expiry of the period of notice.

From time to time We may need to increase the price of the monthly membership or to change the terms and conditions. We will give a minimum of 14 days’ notice by email of any such changes and when the changes will take effect. If You do not wish to continue the membership under the new price and/or Terms and Conditions You can cancel the membership by email within a further 14 days to terminate on the next payment/renewal date and no further payment will be taken. If You do not cancel the membership within the time specified, the price and/or the terms and conditions of the monthly membership will change in accordance with that notice.

 

10. GIFT CARDS
These are valid for 6 months from the date of purchase unless otherwise stated.

11. PRICING INFORMATION

Our fees and pricing arrangements are set out in our Pricing Information. We reserve the right to vary or increase our fees from time to time.

 

12. SAFETY & HYGIENE

12.1 We do not allow crockery or glasses at the Studio unless We have organised this.

12.2 Animals are not permitted in the Studio except for assistance dogs.

12.3 You must pay particular attention to all signs relating to health and safety at our Studio. If You do not understand a notice or sign, please ask one of our team. Fire exits are clearly marked throughout the Studio. In the event of a fire, or fire alarm, You should make your way out of the Studio through the nearest possible exit which is clearly marked.

12.4 You must observe and comply with the Health and Safety procedure guidance in place at the Studio.

12.5 If You suffer an accident or injury on our premises, You must report it and the circumstances under which it happened to the senior manager on duty immediately.

12.6 Smoking is not permitted in any part of the Studio.

12.7 You must follow the reasonable safety direction of the instructor of any Activity.

 

13. STUDENT CONDUCT

13.1 We will show You appropriate respect and You are expected to behave appropriately, respectfully, and politely to Us and all persons at the Studio. We will not tolerate any abuse of our staff or other visitors to the Studio and reserve the right to ask You to leave the Studio should We consider, in our absolute discretion, it necessary for the safety and well-being of You, Us or others.

13.2 You must not be intoxicated with alcohol or drugs when attending our Premises or participating in any of our Activities.

13.3 Mobile phones are NOT permitted in the studio - please leave them in the locker spaces provided. This is for your own and the others enjoyment in class. Take the break!

14. Children’s Health and Safety and Age Restrictions

14.1 Children aged 12 or under must be supervised at all times by an accompanying adult who is responsible for their care.

14.2 Children may only be permitted to participate in an Activity where We have agreed the same in advance. We reserve the right to refuse participation by a child in our Activity in our absolute discretion for any reason and at any time before or during the Activity.

 

15. JURISDICTION & THIRD PARTY RIGHTS

15.1 We shall try to resolve any disputes with You quickly and efficiently. Our Terms and Conditions shall be governed by the laws of Scotland and subject to the exclusive jurisdiction of the Scottish courts.

15.2 In the event of a dispute between us, You and We agree not to engage in any conduct or communications, including on social media, designed to disparage each other or any member of our team.

15.3 No one other than a party to these terms and conditions has any right to enforce any term of our contract or to use any of the facilities that We offer.

 

16. LIMITATION OF LIABILITY

16.1 Except for any legal responsibility that We cannot exclude in law (such as death or personal injury caused by negligence) We are not legally responsible for any losses that (a) were not foreseeable by You and Us when our contractual obligations were formed and (b) that were not caused by any material breach of these Terms on our part. We are also not responsible for any business losses, including loss of business, loss of profits, loss of management time and loss of business opportunity.

16.2 Our total liability to You is limited to the amount of fees that You have paid for the relevant Activity, membership or to Us.

16.3 Neither party shall be in breach of this agreement or otherwise liable for any failure or delay in the performance of its obligations if such delay or failure results from events, circumstances or causes beyond its reasonable control. The time for performance of such obligations shall be extended accordingly. If the period of delay or non-performance continues for 3 months, the party not affected may terminate this agreement by giving 7 days’ written notice to the affected party.

 

17. YOUR INFORMATION & DATA PROTECTION

17.1 Your personal information that You provide Us with will be dealt with in line our with our Privacy Policy which You can access from the Studio Manager on request. If You want to know what information We hold about You, or You want us to correct any information We hold about You, the appropriate procedures are set out in our Privacy Policy.

 

18.BILLING

18.1. We may use a third-party payment processor, Stripe, (the “Payment Processor”) to bill You through a payment account linked to your website account (your “Billing Account”) for paid Services. The processing of payments will be subject to the terms, conditions and privacy policies of the Payment Processor in addition to these Terms of Service. More information is available in our Privacy Policy. We are not responsible for errors by the Payment Processor. By choosing to use paid Services, You agree to pay us, through the Payment Processor, all charges at the prices then in effect for any use of such Paid Services in accordance with the applicable payment terms and You authorize us, through the Payment Processor, to charge your chosen payment provider (your “Payment Method”). You agree to make payments using that selected Payment Method. We reserve the right to correct any errors or mistakes that the Payment Processor makes even if it has already requested or received payment.

 

19. GENERAL GUIDELINES

19.1 You must observe the Studio guidelines which may be notified to You from time to time and are requested to comply with any reasonable directions or instructions which We may issue for the smooth operation of the Studio.

19.2 You should give written notice of any change of address or contact details. Should You fail to do so, all communications that We send to You will be deemed to have been received by You were sent to your last known address or email address.

 

In this disclaimer, our details specified as “we”, “us and “our”, refer to the Company.

 

20. PHOTO RELEASE

For good and valuable consideration, the receipt of which is hereby acknowledged, I hereby authorise the Company to use my likeness in any photograph taken at the Company, in any and all of its publications, including but not limited to all Company printed and digital publications, which includes social media and websites. I understand and agree that any photograph using my likeness will become property of the Company and will not be returned.

 

I acknowledge that since my participation in activities and services offered by the Company is voluntary, I will receive no financial compensation. I hereby irrevocably authorise the Company to edit, alter, copy, exhibit, publish or distribute photos taken on any day for purposes of publicising the Company programs or for any other related, lawful purpose.

In addition, I waive the right to inspect or approve the finished product, including written or electronic copy, wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of the photograph. I hereby deem the Company harmless and forever release and discharge the Company, its staff, and contractors from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorisation.

Terms & Conditions

 

By purchasing from Move Yoga Retreats you agree to all of the terms and conditions stated below.

By proceeding to purchase any of the MOVE YOGA RETREATS, classes, or any service(s), you (the “participant”) acknowledge and agree to be bound by the following Terms and Conditions. The Terms and Conditions may be updated at any time, after providing notice to you. The participant agrees to be bound by any future amendments made to the Terms and Conditions. The participant can review the most current version of the Terms and conditions at any time by accessing the “Terms and Conditions” link on the MOVE YOGA RETREATS website.

Referred to herein as “Participant”. Jointly referred to as “parties” or individually as “party.” WHEREAS, MOVE YOGA RETREATS offers yoga retreats with a purpose and Participant wishes to purchase such retreat.

NOW, THEREFORE, for and in consideration of the mutual covenants contained in this agreement, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties agree as follows:

1. SERVICES. MOVE YOGA RETREATS shall provide Participant with accommodations in the yoga retreat (“the Retreat”). During the Retreat, MOVE YOGA RETREATS will provide Participant daily yoga, barre, fitness session(s), Breathwork, room (personal or shared), all meals listed, and all other activities listed within the retreat guidelines.

2. TERM. The term of this agreement commences upon purchasing the retreat and expires at the end of the final day of the Retreat, unless terminated earlier by either party.

3. PAYMENT. The total cost of the Retreat must be paid in full prior to the retreat as set forth below. Failure to make the payments as set forth below will result in automatic breach of this Agreement by Participant and all payments made by Participant will be forfeited by Participant.

a. Non-Refundable Deposit (a third of the total room cost) is due at time of execution of this Agreement. This deposit reserves your spot in the retreat and it is non-refundable.

b. Balance is due 60 days prior to the start of the Retreat. If your full payment is not made your place is cancelled without refund.

4. CANCELLATIONS. MOVE YOGA RETREATS reserves the right to make any changes deemed necessary, including Retreat cancellation as per MOVE YOGA RETREATS Terms and Conditions. All requests for cancellation by Participant must be submitted in writing, via email at the following email address: hello@moveyoga.co.uk

a. The Participant shall forfeit the Non-Refundable Deposit (the total cost stated when booking) and Administration Fee of £100 upon cancellation of this Agreement regardless of the time of cancellation or the reason for the cancellation. There will be no exceptions, including, but not limited to, travel restrictions, quarantines, medical emergencies, lock downs, weather restrictions, illnesses, Covid-19, travel changes, border closings. The Non-Refundable Deposit and Administration Fee are non-transferable and cannot be applied to a different retreat.

b. Cancellation Notice Received up to and including 61 Days Prior to Start Date of Retreat: In the event that the Participant cancels this Agreement up to and including 61 days prior to the start date of the Retreat, Payments are eligible (but not guaranteed) for refunds, with the exception of the all non-refundable deposits plus £100 administrative fee.

c. Cancellation Notice Received Less than 60 Days Prior to Start Date of Retreat. Participant will not be entitled to any refunds whatsoever if Participant cancels this Agreement less than 60 days prior to the start date of the Retreat.

5. COVID-19 DELIVERABLES BY PARTICIPANT. Participant shall provide a negative Covid-19 test within 48-72 hours from the Retreat start date from the country where the Retreat is being held, even after the Participant’s flight in, if traveling from another country. Participant will be banned from joining and participating in the Retreat without proof of a negative Covid-19 test. Failure to provide such negative testing results will result in forfeiture of all payments made by Participant. The COVID-19 test can be done by either PCR, ANTIGEN or at home LATERAL FLOW kits.

6. THIRD PARTY VENDORS. Third party vendors may be contracted to provide lodging, transportation, catering, meals, and/or other services. Participant understands and acknowledges MOVE YOGA RETREATS is not responsible for the actions or negligence of such third party vendors. Any claim Participant may have against third party vendors shall be initiated against the third party and not MOVE YOGA RETREATS.

7. SEVERABILITY. The invalidity of any portion of this Agreement will not and shall not be deemed to affect the validity of any other provision. If any provision of this Agreement is held to be invalid, the parties agree that the remaining provisions shall be deemed to be in full force and effect as if they had been executed by both parties subsequent to the expungement of the invalid provision.

8. NO WAIVER. The failure of either party to this Agreement to insist upon the performance of any of the terms and conditions of this Agreement, or the waiver of any breach of any of the terms and conditions of this Agreement, shall not be construed as subsequently waiving any such terms and conditions, but the same shall continue and remain in full force and effect as if no such forbearance or waiver had occurred.

9. GOVERNING LAW. All terms of these Terms and Agreements shall be governed by, construed, and enforced in accordance with the laws of Scotland, without regard to conflicts of laws provisions. The parties hereby submit to the sole and exclusive jurisdiction of Scotland in any action, suit or proceeding arising out of or relating to MOVE YOGA RETREATS.

10. DAMAGE TO PROPERTY. In the event that the participant damages the property and/or the possessions and items within the property, the participant must pay for the damage costs. MOVE YOGA RETREATS is not responsible for the damage made to or within the property by such participant and therefore will not pay for the damage. The participant must pay damage costs to the property owner directly.

11. FULL ROOM DISCOUNT. If the participant has booked under the full room discount option, the participant has full responsibility to fill the room to the bed capacity stated. There will be no refund issued or discounts granted if one, two, three or four participants from the room is/are no longer able to attend for any reason whatsoever. Please refer to section 4 for cancelation policy.

12. RIGHT TO REFUSE SERVICE. MOVE YOGA RETREATS reserves the right to accept, decline, or retain any person as a participant at the Retreat at any time without liability and without any obligation to pay a refund or any other amount whatsoever. In maintaining the purpose and objective of the yoga Retreat, MOVE YOGA RETREATS may decline Participant from taking part of the Retreat if Participant displays violent behavior, including, but not limited to language and/or actions. MOVE YOGA RETREATS is not responsible or liable for any participant who leaves the Retreat prior to its conclusion or for any activity undertaken by the Participant that is not part of the Retreat.

13. NO WARRANTIES. MOVE YOGA RETREATS makes no warranties or representations, stated or implied, regarding any aspect of the Retreat. In particular, there is no guarantee, stated or implied, regarding:

a. The number of participants or the age of participants taking the Retreat;

b. The amount of time that Katy Wakefield, or other volunteers, will be personally leading the Retreat;

c. The time spent at any given location on the Retreat;

d. Photos taken and/or posted on MOVE YOGA RETREATS website and social media channels or visiting any specific sites shown on photos on MOVE YOGA RETREATS website and social media channels.

e. The quality of workouts, skill sessions, or other subjective experiences on the Retreat; or

f. Any other aspect of the Retreat.

14. INSURANCE. Participant is strongly advised to obtain travel, medical, accident, cancellation, and baggage insurance independently, especially if traveling from abroad. MOVE YOGA RETREATS will not provide Participant with any insurance aforementioned and it is the sole responsibility of Participant to obtain.

15. ALLERGY DISCLAIMER. MOVE YOGA RETREATS contracts third party vendors to provide catering and meals and room and board to Participant, as such, MOVE YOGA RETREATS does not guarantee an allergen-free environment. Participant is aware that Participant will be exposed to food, activities, tangibles, and persons which may result in exposure to allergens and Participant acknowledges assumption of the risk. Participant shall be fully responsible for any medical costs or expenses related to allergic reactions, food sickness, food poisoning or any other related conditions.

16. ROOMS AND ACCOMMODATIONS. MOVE YOGA RETREATS provides rooms/accommodations to Participant to provide a full experience retreat. Such accommodations include villas, cottages, resorts, rooms, and others, as may be available in the locality of the retreat. Such housing, lodgings, rooms, or accommodations are not owned by MOVE YOGA RETREATS and MOVE YOGA RETREATS is not responsible for providing security to Participants. MOVE YOGA RETREATS is not responsible for any theft, damage, injury, loss, acts of terrorism, or the like, to Participant. Moreover, Participant expressly waives any right (whether in contract, tort, or both), to hold MOVE YOGA RETREATS liable for any of the aforementioned acts. Participant shall exercise ordinary care in safeguarding any personal belongings or possessions. Participant acknowledges Participant is entirely responsible for his/her personal safety, health, and well-being during the Retreat.

17. PERSONAL EXPENSES. Participant shall be responsible for personal excursions, personal expenses, souvenirs, and anything else which is not expressly included in the Retreat by MOVE YOGA RETREATS.

18. CANCELLATION DUE TO TRAVEL CONDITIONS. MOVE YOGA RETREATS is not responsible or liable for any cancellations due to weather or travel conditions, including, but not limited to the following:

a. Any changes or delays in air schedules, missed airline or other carrier connections, or other services, local transportation, missed flights, missed or cancelled bus's or trains, cancelled flights;

b. Injury, loss, illness or damage to persons or property, including luggage and sponsored gift items;

c. Additional expenses resulting from changes in exchange rates, tariffs, visas, vaccinations or schedule change;

d. Defect in any vehicle or the act or default of any company or person engaged in conveying the Retreat Participants, or in carrying out the arrangements of the Retreat, or otherwise;

e. Additional expenses incurred or due to including but not limited to: sudden sickness, weather conditions, strikes, or other causes or acts of God; or losses due to cancellations.

19. PUBLICATION RELEASE. Participant may be photographed, audio-recorded and/or video-recorded during the Retreat. MOVE YOGA RETREATS reserves the right to publish any such photographs, audio recordings, and video recordings without obtaining further consent from any participant.

Participant authorises MOVE YOGA RETREATS to use such recordings or images by MOVE YOGA RETREATS in the course of business, for any lawful purpose, including for use on MOVE YOGA RETREATS website, social media channels, marketing materials, media publications, online and print advertising. Including but not limited to; website www.moveyoga.co.uk AND social medial channels @katywakefield_yoga and @Moveyoga.studio. Participant releases MOVE YOGA RETREATS and its representatives from any liability in connection with any such use of such photographs, audio recordings, and video recordings.

20. NO MEDICAL TREATMENT. Participant understands and acknowledges that the Retreat is in no way psychotherapeutic or medical in nature. The Retreat is not involved with the treatment of disease, illness, or condition of any kind and does not, in any way, substitute for medical diagnosis or treatment. MOVE YOGA RETREATS does not, or any of its volunteers, agents, assigns, officers, or employees treat, prescribe, or diagnose any illness, disease, condition, or any other physical or mental disorder. Any personal advice or answers provided during the Retreat are for entertainment purposes only.

OFFICERS, AGENTS, VOLUNTEERS, AFFILIATES, AND EMPLOYEES.

PARTICIPANT FURTHER HEREBY AGREES TO INDEMNIFY AND HOLD MOVE YOGA RETREATS, ITS OFFICERS, AGENTS, VOLUNTEERS, AFFILIATES, AND EMPLOYEES HARMLESS FROM ANY LOSS, DAMAGE, JUDGMENT, LIABILITY OR EXPENSE (INCLUDING LEGAL FEES) SUFFERED BY OR RENDERED AGAINST MOVE YOGA RETREATS ON ACCOUNT OF ANYTHING ARISING OUT OF THIS AGREEMENT.

PARTICIPANT UNDERSTANDS AND ACKNOWLEDGES THERE ARE INHERENT RISKS IN PHYSICAL TRAINING, INCLUDING YOGA EXERCISE ACTIVITIES. PARTICIPANT SHALL CONSULT WITH A PHYSICIAN PRIOR TO PARTICIPATING IN THE RETREAT AND OBTAIN PRIOR APPROVAL TO PARTICIPATE. PARTICIPANT RELEASES MOVE YOGA RETREATS FOR ANY MEDICAL EXPENSES, MEDICAL CARE, MEDICAL NEEDS FOR ANY INJURY PRIOR, DURING OR AFTER THE RETREAT. THIS INCLUDES MEDICAL EXPENSES, MEDICAL CARE, MEDICAL NEEDS OR DAMAGE FOR ANY COVID-19 RELATED EXPENSES.

PARTICIPANT IS ENTIRELY RESPONSIBLE FOR ITS OWN PERSONAL SAFETY, HEALTH, AND MENTAL, PHYSICAL, EMOTIONAL, AND GENERAL WELL-BEING BEFORE, DURING, AND AFTER THE RETREAT. PARTICIPANT HEREBY RELEASES MOVE YOGA RETREATS, ITS OFFICERS, AGENTS, VOLUNTEERS, AFFILIATES, AND EMPLOYEES OF ANY LIABILITY FOR ANY INJURIES OR DAMAGES MENTALLY OR PHYSICALLY THAT PARTICIPANT, OR PARTICIPANT’LS FAMILY MEMBERS, MIGHT SUFFER DURING OR AFTER THE RETREAT.

Before participating in this or any other exercise program, individuals should consult with a physician. I, the undersigned, acknowledge that I am 16 years of age or over and have voluntarily chosen and requested to participate in the retreat, class, private, workshop, event, or activity with Move Yoga Retreats and the yoga teacher Katy Wakefield and any other facilitator assisting or leading a class, private, workshop, event or activity at Move Yoga Retreats. 

Acknowledgment 
I am aware that participation in the classes, privates, workshops, events, or activities may be hazardous. I acknowledge that a certain minimum level of physical health, strength, fitness, and flexibility will be required. I represent that I possess the level of health, strength, fitness, and flexibility necessary to participate in these activities. I am voluntarily participating in these activities with knowledge of the risks of injury. I assume all responsibility and liability for any and all injuries I may sustain due to my participation in these activities. 

Release 
In consideration for being permitted to participate in the classes, privates, workshops, events, or activities, I agree that I, my heirs, assignees, guardians, and legal representatives will not make any claim against, sue, or attach the property of, any of the hosts, instructors, organisers, or participants in the classes, privates, workshops, events, or activities including but not limited to Move Yoga Retreats, for injury or damage resulting from my participation in such classes, privates, workshops, events, or activities. I release all such hosts, instructors, organisers, and participants, their agents and heirs, from any and all actions, causes of action, lawsuits, claims, or demands that I, my assignees, heirs, guardians, and legal representatives now have or hereafter may have for any and all injury, illness, loss of life, loss of or damage to property associated with my participation in the classes, privates, workshops, events, or activities. I have carefully read this agreement and fully understand its contents. I am aware and agree that it is a complete release of liability for any injuries or damages I may sustain due to classes, privates, workshops, events, and activities with Move Yoga Retreats and all such hosts, instructors, organisers, and participants. 


Pregnancy Waiver (if relevant) 
In addition to the above Release, I agree now and in the future if I become pregnant that by signing this Liability, I release and hold harmless Move Yoga Retreats, and their supporting instructors, volunteers, childcare workers, and all other persons or entities acting for her, from any and all claims, demands, suits, cost and charges, in connection with or arising out of services offered by Move Yoga Retreats, including but not limited to, personal injury, bodily harm, injury, and/or property damage. I agree I have been advised that Move Yoga Retreats and supporting instructors, volunteers, childcare workers and all other persons or entities acting for her are not trained pregnancy or antenatal professionals, and attendance to non-pregnancy specific classes is not recommended. I agree the attendance of any non-pregnancy specific classes is against the recommendation of Move Yoga Retreats and that I have consulted with a medical professional and they have advised attendance to heated or non-heated, non-pregnancy classes to be satisfactory.
